Terms of Service

These Terms of Service ("Terms") govern access to and use of Pixverax at pixverax.com (the "Service"), operated by Pixverax LLC, a LLC formed in Delaware (file no. PENDING) ("Company", "we", "us").
1. Agreement
By creating an account, purchasing credits or a subscription, or using the Service, you agree to these Terms, our Privacy Policy, Acceptable Use Policy, and AI Use Policy.
2. The Service
Pixverax provides AI-assisted image and video generation tools and related account, billing, and library features. Features may change as we improve the Service.
3. Accounts
You must provide accurate information and keep credentials secure. You are responsible for activity under your account. The minimum age to use the Service is governed by our site configuration and applicable law.
4. Credits, subscriptions, and fees
Credits may be granted on signup, via subscription allotments, or as one-time purchases. Unused credits expire 12 months after issuance unless a specific lot states otherwise. Credits are consumed oldest-first. Credits have no cash value and are non-transferable except where required by law.
All prices are in USD unless stated otherwise. Taxes may apply based on your location and our tax mode.
5. Acceptable use
You must comply with the Acceptable Use Policy. We may suspend or terminate accounts that violate these Terms or applicable law.
6. AI outputs and ownership
Subject to your compliance with these Terms and third-party model provider terms, you may use generated outputs for lawful purposes. Outputs may include provenance metadata that must not be stripped where required by law. We do not warrant that outputs are unique, non-infringing, or fit for a particular purpose.
7. Refunds
Refunds are described in our Refund Policy. The standard refund window is 7 days where eligible.
8. Retention
Free-tier artifacts may be deleted after 30 days. Paid-tier artifacts may be retained for 12 months after the relevant subscription or purchase period ends, unless you delete them earlier or law requires longer retention of records.
The Service's application compute, primary database, and object storage are primarily located in the United States. International transfers of personal data are governed by the Privacy Policy and applicable transfer safeguards.
9. Disclaimers and limitation of liability
THE SERVICE IS PROVIDED "AS IS". TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMPANY DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. OUR AGGREGATE LIABILITY ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE TWELVE MONTHS BEFORE THE CLAIM.
10. Governing law
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules, except where mandatory consumer protections apply.

12. Changes
We may publish updated Terms under a new document version. Material changes that require renewed consent will be communicated as described in our policies.
